Mindful Kitchen, Inc., operates under the business name of Mindful Kitchen and under the website www.amindfulkitchen.com. It includes all services rendered under the name of Mindful Kitchen. Any use of our services constitutes an acceptance of our Terms of Services and our Policies, which state that there are inherent risks that you are willing to accept when using our services. Terms of Service:
- Food Handling: You understand and agree that you will be solely responsible for, and assume the risk of, the food handling procedures which you employ during the use of any Mindful Kitchen service or after any food prepared by you or by Mindful Kitchen is removed from the Mindful Kitchen premises including, but not limited to, the freezing, refrigerating, and subsequent preparation of the food. Mindful Kitchen recommends that all baking and cooking instructions specified on all meals be followed, including, but not limited to heating all meals to an internal temperature above 145F for steak, 155F for fish or ground beef and 165F for poultry prior to consumption.
- Allergens: Please note that the Mindful Kitchen facility is not an allergen free facility. The facility may contain all known food allergens, including, but not limited to, dairy products, eggs, tree nuts, seafood, shellfish, peanuts, wheat, gluten, soy and corn. Mindful Kitchen staff members use shared equipment to process various allergen containing ingredients and cross contamination may occur among food products.
- Limitation of Liability of Mindful Kitchen, its suppliers or its licensors. Except otherwise expressly stated, in no event will Mindful Kitchen, its suppliers or its licensors be liable to you or any other party for any direct, indirect, special, consequential or exemplary damages, regardless of the basis or nature of the claim, resulting from any use of the website and/or any Mindful Kitchen service including without limitation any lost profits, business interruption, or otherwise, even if Mindful Kitchen, its suppliers or its licensors were expressly advised of the possibility of such damages. In no event will the aggregate liability for any and all of your claims against Mindful Kitchen, its suppliers and its licensors arising out of our related to use of the Mindful Kitchen website and/or a Mindful Kitchen service exceed the amounts actually paid by you to Mindful Kitchen during the 12 month period prior to the date a claim is made.
- Indemnification. You agree to defend, indemnify and hold harmless, Mindful Kitchen, its contractors, and its licensors, and their respective directors, officers, members, managers, employees and agents from and against any and all claims and expenses, including attorney’s fees, arising out of your use of the Mindful Kitchen website and/or any Mindful Kitchen service.
- These terms and conditions constitute an agreement between Mindful Kitchen and you. Except to the extent applicable by law, if any, provides otherwise, these Terms and Conditions, any access to or use of the Mindful Kitchen website will be governed by the laws of the state of Illinois.
